When to request it?
Every woman or pregnant person who suspects or has confirmed an unplanned and unwanted pregnancy has the right to access information and medical services without any barriers, allowing them to make an informed decision.
Ruling C-055 of 2022
In 2022, the Colombian Constitutional Court recognized the right of women and pregnant people to access abortion without any restrictions up to the 24th week of pregnancy. After that period, Ruling C-355 of 2006 applies, allowing abortion under one of the three legal grounds for decriminalization:
- When continuing the pregnancy poses a risk to the life or health of the woman or pregnant person. This risk occurs when the circumstances of the pregnancy force a decision between the woman’s life and the continuation of the pregnancy. It must also be recognized that an unwanted pregnancy can significantly affect physical, mental, and/or emotional well-being.
- When there is a severe fetal malformation that makes life outside the womb nonviable.
- When the pregnancy results from sexual assault, non-consensual intercourse, abusive sexual acts, non-consensual artificial insemination or embryo transfer, or incest.
This ruling has been widely studied in law schools around the world, as it was the first time the following concept was articulated: “When adopting criminal norms, the legislator cannot disregard that women are fully dignified human beings and must be treated as such, rather than being viewed and turned into mere instruments of human reproduction, or being forced, against their will, to serve as useful tools for procreation.”.
Safe Abortion Services through EPS
Safe abortion services are part of the Health Benefits Plan (POS) that all EPS (Health Insurance Providers) must offer to their affiliates. Profamilia is an IPS (Health Service Provider) that offers these services through agreements with some EPS or on a private basis.
